Foxridge Rules and Regulations:

 
Foxridge Rules & Regulations were adopted by the Board of Directors and reflect Code Enforcement laws of Clay County that were promulgated to maintain the integrity and values of our community through enforcement and beautification.


There are many pedestrians and walkers in the Foxridge Community.   Our posted speed limit is 25.   Thanks for using caution and obeying the speed limit.



                       
Foxridge Rules and Regulations
( County requirements shown in underline text)

1. Homes are to be used for residential purposes unless permitted by law.  The RB zoning district allows single-family homes but also permits the accessory and conditional uses identified in the attached document.

2. No parking of commercial vehicles in any part of front or side yard or on the public street overnight is permitted. The parking of commercial vehicles of one ton or more rated capacity in any part of the front, rear, side yards, residential areas, roads, or rights-of-way is not permitted in the RB zoning district.  Commercial Vehicles are defined as any motor vehicle or trailer, one ton or larger which is used for transportation of materials, equipment, and items other than of private passengers.

3. We ask that vehicles are parked on driveways, garages, public parking space, and not on front lawns. The county does not prohibit the parking of vehicles on front lawns.

4. Junk/Inoperable vehicles or vehicles without current registration/license tags are not permitted unless stored in garage.  Junk vehicles are defined as a vehicle which is dismantled, wrecked, junked, and/or non=operating and/or lacking a valid tag.  Junk vehicles are prohibited on public and private property with the exception of junk vehicles kept within an Enclosed Garage and/or a maximum of two junk vehicles kept under fitted covers in the rear yard.

5. Out-buildings and storage sheds are permitted but only in the yard behind the dwelling and fence and must have proper County permit.  Accessory structures are allowed within the rear yard only and must be permitted by the county.

6. Garbage to be retained in watertight receptacles and to be removed from street as soon as possible. Clay County's Solid Waste Francising and Collection Ordinance (90-24) allows for receptacles and bundles for hand pickup service to be placed at the curb prior to 6:00 a.m. on the day of collection.  In no case, however, shall receptacles or bundles be placed on public right-of-way more than twelve hours prior to the day of collection.  The normal hours of collection are after the hours of 6:00 a.m. on days designated by the franchisee.  The customer shall place receptacles and bundles ready for collection at a maximum distance of ten feet from the travled, graded, or paved portion of the right-of-way and adjacent to the customer's driveway.

7. It is a violation of the Florida Uniform Traffic Control Law to park in a manner, to obstruct the passing of emergency vehicles on a public street.  This is a statutory requirement.  See Section 316.2045.F.S. attached.

8. Do not block streets or driveways used for ingress and egress. Article VIII of the Clay County Land Dvelopment Code, Design and Improvement Standards, requires that all parking areas be designed in conjunction with the interior circulation pattern to promote orderly flow of all traffic without encroachment of vehicles into pedestrian areas, landscape areas, or traffic cirulation areas.

9. Trailers and boats should be stored in rear yard out of view from the street.  
Trailers and boats may be stored in any location on the property.  Junk trailers or trailers considered to be commercial vehicles are not permitted. 

10. Lawns and shrubs to be maintained on a regular basis during growing season.  Per the 1985 Standard Housing Code, it is the duty and responsibility of every owner or occupant of a residence to keep the premises of the residential property clean and to remove from the premises all weeds, dead trees, tras
h, garbage, etc. 

11. Maximum of two garage sales per calendar year.  Garage sales will be allowed up to a maximum of two garage sales within any calendar year.  The duration of each garage sale shall be a maximum of 72 hours and may be conducted only within daylight hours.  No sign advertising a garage sale may be placed on any public right of way.

12. No noxious or offensive trade or any activities shall be carried on which shall become an annoyance.  While the RB zoning district does not specifically prohibit activities which are considered to be noxious or offensive, activities trhat generate these behaviors could be associated with or considered to be illegal activities which may be enforceable by law.

 NUISANCE

Chapter 17 of Code Enforcement outline a NUISANCE as follows:


(a.) Noxious weeds or other rank vegetation;  Excessive accumulation of untended growth or weeds, grass, underbrush, or undergrowth.  Any condition which provides harborage for rats, mice, snakes, and vermin: ex: un-cut grass growing around trailers and boats.

(b.) Buildings or structures in dilapidated and run down condition;  accumulation of rubbish, trash refuse, junk or other abandoned materials, metals, lumber, other things.

(c.) Noise levels prohibited by Chapter 16, for example, barking dogs, people, and devices i.e. radios, Call Clay County Sheriff.

Signs:

Signs in the right-of-way, on utility poles or trees are prohibited.  There are different regulations for political and real estate signs. 

Swimming Pools:

All swimming pools must be permitted, placed a correct distance from the property line and properly enclosed.  The fence must be at least 4 feet in height with no openings larger than 4 square inchesl  The gate must be equipped with a self latching, locking device and mst be kept closed at all times.  Other requirements and restrictions may apply so check with the Building Department.

Fences:

In the residential zones, RA, RB, RC, RD and RE, the fence in the front yard and along the side of the dwelling cannot be higher than 4 feet;  the fence around the rear yard, beginning at the rear corners of the house cannot be higher than 8 feet.  There are no fence requirements for the AG, AR, AR-1 and AR-2 zoning districts.

Permits:

All structures must be permitted prior to placement on premises, including canvas carports/boat-ports, pole barns and sheds.  Setbacks from property lines for all structures must be met.  Before you purchase a shed or carport, check with the Building Department to see what is required before you spend the money.

Other Permits which you might need include:

Home Occupancy Permit - Home office type business without outside storage or employees, if you advertise home phone or home address.
Transient Merchant - Temporary outdoor sales of seasonal items, i.e. pumpkins, Christmas trees, firewood, etc.
Roadside Solicitation - Collection of money by non-profit organizations based in Clay County.
Private Drainage Ponds/Agricultural Livestock Ponds - Ponds dug after 1991 must be permitted and fenced.
Borrow Pits - Pits dug for transfer and/or sale of dirt must be appropved by engineering Department and Zoning Department.

Land Use (Penalty for Unauthorized Use of Land)

(Article III Land Development Regulations)
It shall be unlawful for any person to use any land in a manner not specifically permitted as a use within the zoning classification applicable to such land, or permitted by a conditional use authorized under the provisions of Article III.  It shall be prohibited to establish a non-residential use without meeting all Clay County Land Development Regulations, such as, but not limited to, paved parking, landscaping, drainage, etc.  It shall also be prohibited to subdivide land without meeting the Clay County subdivision requlations.  Any person found guilty of violating these regulations shall be deemed guilty of an offense and shall be punishable through the court system or enforcement of this section may also be sought through the Code Enforcement Division.

Noise Ordinance

A noise violation is prosecuted as a civil infraction.  Please refer to the Noise Ordinance for specific guidlines on enforcement issues as well as exceptions.

Obstruction of County Right-Of-Way

Clay County Code
It is unlawful to park any motor vehicle or trailer across or upon any sidewalks for pedestrians, or park on the road right-of-way in any manner that would create a health/safety concern for the public.  (Contact Clay County Sheriff's office for enforcement).

It is unlawful to place any structures, including basketball hoops or skateboard ramps in the rights-of-way (Please see Construction in County Right-Of-Way).  Please contact the Engineering Department at (904)-284/269-6301 regarding the placement of structures, including basketball hoops or skateboard ramps in the right-of-way.

Overgrowth

Excessive Accumulation and Growth (Weeds and Grass)

It shall be unlawful for the owner or occupant of an improved or unimproved property to utilize the premises for open storage of any inoperable motor vehicle including parts, ice box, refrigerator, stove, glass, building material, building rubbish or similar items.  It shall be the duty and responsibility of evry such owner or occupant to keep the premisses of such property clean and to remove from the premises all such abandoned items as listed above, including but not limited to weeds, dead trees, trash, garbage, etc.

Other County Departments:

Animal Control:  Enforces the Animal Control Ordinance - animals running at-large, animals without current vaccinations, and fierce or ferocious animals.
Building Department:   Enforces the Florida Building Code.
Engineering Department: Enforces the drainage flow and the rights-of-way.
Environmental Health Department:  Inspects sewer systems and swimming pools.
Public Works Department:  Maintains our county's roads, ditches, rights-of-way, street signs and traffic signals.
